Privacy Policy

Ziv Spinal (operating under ABN 42445987876) is committed to providing quality services to you.

We have adopted the Australian Privacy Principles contained in the Privacy Act 1988 which govern the way we collect, use, disclose, store, secure and dispose of your personal information. You can find a copy of these principles at https://www.oaic.gov.au/.

This policy explains how we handle your personal information when you provide it through:

• our website
• our third-party practice software
• email
• telephone
• in-person

It also covers any photos we take with your permission in practice to track changes to your posture and overall wellbeing.

What is ‘personal’ or ‘sensitive’ information and why do we collect it?

Personal information is information that identifies an individual. This can include their name, date of birth, address, email address or phone number.

Sensitive personal information may be information that relates to an individual’s health or genetics, racial or ethnic origin, religious or philosophical beliefs, or other sensitive information.

Sensitive personal information is only used by us:

• for the primary purpose of providing, or giving information about, our services to you
• for a secondary purpose directly related to the primary purpose
• with your consent or where required or authorised by law.

The nature of our services generally requires the collection of sensitive information, and we are required by our insurer to maintain this information for a certain time period (detailed below).

Wherever possible, we will explain why we are collecting your information and how we plan to use it. You are welcome to ask us any time if you do not understand.

Disclosure of personal information

Your personal information will only be disclosed in highly specific circumstances, such as:

• to third parties where you consent to the use or disclosure
• where required or authorised by law
• to enforce or apply our agreements with you
• to protect the rights, property or safety of us, our clients or others

We do not sell any personal information we collect to any third parties.

We will only ever share success stories, testimonials, and before and after photos with others if we have your express permission.

How we secure your personal information

We use carefully selected third party suppliers to help manage our services and securely store your data according to best practice. This includes Cliniko practice management software which meets or exceeds all regulations of the Australian Privacy Principles. You can view their security features here. You may also wish to read the Cliniko privacy policy.

You can always ask us to review your stored data to ensure it is accurate and best serves you. If this request is not in person, we may require identification before releasing the requested information.

If you wish to pre-pay services (such as to secure a package price), we use Stripe as a third-party payment facilitator. This ensures your financial data is secure and we have no need to access or store your payment details. See the Stripe privacy policy.

We ensure the security of your personal data to prevent misuse, loss, or unauthorised access. Our efforts to safeguard your information are diligent, yet we cannot guarantee absolute protection. We do not assume liability for any breaches resulting from transmission errors, unauthorised access, or circumstances beyond our control.

How long we keep your personal information

When your personal information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify it. However, most of the personal information is or will be stored in client files which will be kept by us for a minimum of seven (7) years as required by our insurer.

Services to minors

If you are under 18 years of age your parent or guardian must agree to this Privacy Policy and terms for you. They are responsible for ensuring that you fully understand what you are sharing with us and why.

We conduct all sessions with any person under 18 years old with a parent or guardian present at all times.
